These Terms & Conditions govern access to and use of Phaser. They apply together with Phaser's Platform Rules, Privacy Policy, Cookie Policy, and Intellectual Property Policy.

References to “Phaser”, “we”, “us”, or the “Service” in these Terms refer to the Phaser platform and its operator.
By creating an account or otherwise accessing or using Phaser, you agree to these Terms and the policies incorporated into them.
If you do not agree, you must not create an account or continue using the Service.
Nothing in these Terms limits any mandatory right or legal protection that cannot lawfully be waived or excluded.
Phaser is a digital music-discovery platform intended to help artists present music-related content and help fans discover, recommend, and interact with artists.

You may use Phaser only if you meet the minimum age and legal-capacity requirements applicable in your country of residence.
Where the involvement or consent of a parent or legal guardian is required by law, you may use the Service only with that valid involvement or consent.
By using Phaser, you represent that:
Phaser may restrict or remove an account where it reasonably believes that the applicable age requirements have not been satisfied.
Certain features require an account. When creating or maintaining an account, you agree to provide information that is accurate, current, and not materially misleading.

You must not sell, transfer, share, or make your account available to another person in a manner that creates security, impersonation, or ownership risks.
Phaser may refuse a registration or restrict an account where reasonably necessary to prevent fraud, impersonation, abuse, duplication, security risks, or violations of law or platform policy.
An artist-managed profile is a profile created or controlled through an artist account.
The person controlling an artist-managed profile must be the artist or have appropriate authority to act for the artist.
Users must not falsely claim to represent an artist, label, management company, distributor, publisher, rights holder, or other organisation.
Phaser administrators may create limited artist profiles before the relevant artist has created or registered an artist account.
These profiles are intended to organise and present limited publicly available professional information and facilitate music discovery.
An administrator-created profile may include:
Such profiles will be identified, where appropriate, as Unofficial, Fan-made, Not managed by the artist, or through another similarly clear notice.
An unofficial profile has not necessarily been created, verified, approved, managed, sponsored, or endorsed by the artist.
Phaser does not claim ownership of the artist's name, music, likeness, artwork, trademarks, or other protected rights and does not claim to represent the artist.
Unofficial profiles must not contain private, sensitive, intimate, defamatory, or unnecessary personal information.
For an administrator-created artist profile that has not yet been claimed, an artist, authorised representative, rights holder, or other affected person may use the dedicated public profile-request form or contact Phaser.
The request process may be used to:
A request may require the requester's name, email address, role or relationship to the artist, an explanation, an official reference URL, verification details, and a good-faith confirmation.
Submission does not automatically prove identity, authority, ownership, or entitlement to control the profile. Before granting access, merging or removing a profile, disclosing account information, or taking another identity-sensitive action, Phaser may request proportionate verification.
Requests are recorded for administrative review and may be marked as pending, verification required, verified, accepted, rejected, or resolved. Phaser may correct, relabel, hide, restrict, merge, transfer, or remove a profile where appropriate.
Phaser may reject requests that are fraudulent, abusive, contradictory, materially incomplete, unsupported, or not reasonably verifiable. Phaser will normally remove or restrict an unofficial profile where a verified artist or authorised representative raises a valid objection and Phaser has no overriding lawful reason to maintain the relevant processing.
Users may create public profiles containing usernames, display names, profile images, general location information, genres, tags, links, media, biographies, and other profile information supported by the Service.
You must not use a profile to:
Profile images and other visual materials are subject to the same ownership, privacy, image-rights, and authorisation requirements as other User Content.
“User Content” means any content or information submitted, uploaded, created, published, linked, embedded, recommended, communicated, or otherwise made available by a user through Phaser.
User Content may include:
Information inserted directly by Phaser into an administrator-created unofficial profile is not treated as content submitted by the artist.
You retain any ownership rights you hold in your User Content.
Phaser does not acquire ownership of User Content merely because it is submitted to the Service.
By making User Content available through Phaser, you grant Phaser a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, technically process, format, transcode, display, communicate, distribute, index, and make that User Content available only as reasonably necessary to:
This licence may include technical actions such as resizing, compression, transcoding, formatting, thumbnail generation, and indexing.
The licence applies only to rights you are legally able to grant.
Linking to or embedding third-party content does not grant Phaser ownership of or a separate licence to the underlying third-party work beyond the technical use permitted by the relevant service, rights holder, or applicable law.
The licence normally ends when the relevant User Content is deleted from active systems, except where limited continued processing is reasonably necessary for:

Phaser may require an upload declaration or checkbox confirming these matters.
Such confirmation does not prevent Phaser from removing or restricting content following a complaint, legal obligation, or policy concern.
Artist accounts may make available audio, images, videos, external links, embedded media, news, Spotlight content, and promotional materials.
The submitting user is responsible for obtaining all rights reasonably required for the intended use, including where applicable:
Phaser does not routinely determine complex ownership, authorship, licensing, royalty, publishing, label, or contractual disputes.
Where rights are credibly disputed, Phaser may temporarily restrict or remove the affected content while the matter is assessed.
Fans may create profiles and publish Picks, recommendations, comments, opinions, links, and other artist-related content.
Fan commentary may express opinion, criticism, recommendation, or enthusiasm, but must not:
The fact that an image or other material is visible on a search engine, social network, streaming platform, or public website does not itself provide permission to upload a copy to Phaser.
Phaser may allow links to or embeds from external websites, music platforms, video services, streaming services, and social platforms.
Phaser does not own or control third-party services and does not guarantee their availability, accuracy, legality, security, policies, or continued functionality.
A link or embed does not necessarily mean that Phaser has separately licensed or endorsed the underlying content.
Users must not knowingly link to or embed content that:
Phaser may disable a link or embed where a valid complaint is received, the source restricts its use, the source becomes unavailable, or continued display creates a reasonable legal or security concern.
Phaser may provide national and regional discovery, search, filters, Trending, recommendations, curated selections, ranking systems, and other visibility features.
Phaser does not guarantee any user, artist, profile, track, Pick, or other content:
Ranking and discovery may be affected by combinations of:
Phaser may adjust these systems to improve relevance, fairness, security, moderation, or the quality of discovery.
Phaser may test or use automated, algorithmic, or AI-assisted systems to support discovery, curation, quality review, ranking, recommendation, moderation, security, or platform-integrity functions.
Where enabled, such systems may analyse uploaded audio or related content using technical, musical, curatorial, or integrity-related indicators.
Possible indicators may include:
AI-assisted results may be reviewed, limited, overridden, or disregarded by administrative, fan-based, moderation, or curatorial processes.
AI-assisted review does not guarantee approval, promotion, rejection, demotion, ranking, visibility, or any other particular result.
Phaser does not intentionally use artist audio to train third-party general-purpose AI models and does not authorise service providers to use such audio for their own independent model training unless a separate lawful basis and, where required, explicit consent exist.
Phaser may use technical service providers to perform or support analysis. Their processing must be governed by applicable contractual, security, and data-protection requirements.
Nothing in these Terms excludes responsibility that Phaser may have for selecting, instructing, or appropriately overseeing its service providers under applicable law.
If Phaser becomes aware of a material and unacceptable change in a provider's data-use practices, Phaser may suspend, reconfigure, replace, or discontinue the affected processing.
Phaser may use fan voting or rating mechanisms to support Trending, discovery, ranking, recommendation, curation, and platform-integrity decisions.
Where available, eligible fan users may be invited to rate or vote on an artist, track, profile, or other content item.
Aggregated outcomes may contribute to:
Phaser may apply reasonable participation thresholds, anti-abuse controls, weighting systems, eligibility requirements, and administrative review.
Phaser may disregard or reverse results affected by manipulation, fraud, coordinated abuse, technical errors, or other platform-integrity concerns.
Phaser may use administrative, editorial, or curatorial review to confirm, adjust, or reverse ranking, Trending, fan-review, recommendation, moderation, or AI-assisted outcomes.
Such review may consider:
Ordinary editorial or ranking adjustments do not necessarily constitute a finding that content is illegal or that the user has violated these Terms.
Where a material visibility restriction is imposed because content is considered illegal or contrary to Phaser's policies, Phaser will provide the affected user with an explanation where required by applicable law.
Users may follow accounts, view followers, establish contacts, and interact through supported platform features.
Phaser does not guarantee that another user will:
Users are responsible for evaluating interactions and arrangements with other users and must not use Phaser for harassment, fraud, threats, stalking, or other abusive conduct.
You must not:
Subject to user and third-party rights, the Service's non-user-generated elements are owned by Phaser or its licensors.
These elements may include:
Except as permitted by law or expressly authorised, you may not reproduce, mirror, redistribute, sell, license, or commercially exploit these materials.
Nothing in this section claims ownership over artist names, user content, third-party media, or other material owned by users or third parties.
Users, artists, rights holders, and affected persons may report content, profiles, links, embeds, or activity believed to violate applicable law, third-party rights, these Terms, or Phaser's policies.

Where valid electronic contact information is provided, Phaser will acknowledge receipt without undue delay where required by applicable law.
Reports will be reviewed in a timely, diligent, objective, and non-arbitrary manner.

False, abusive, retaliatory, or fraudulent reports may be rejected and may result in account action.

Where Phaser materially restricts user-submitted content or an account because it considers the content illegal or contrary to these Terms, Phaser will provide the affected user with a clear explanation of the main reasons where required by applicable law.

Information may be limited where necessary to protect safety, privacy, security, fraud-prevention measures, confidential information, legal proceedings, or the rights of others.
If your content or account is removed, restricted, suspended, terminated, or otherwise materially affected and you believe the decision was incorrect, you may request an internal review by contacting:

Eligible complaints will be handled electronically and free of charge.
Review decisions will not be made solely through automation where applicable law requires appropriate human supervision.
Filing a review request does not guarantee reversal of the original decision.
Where applicable law provides access to certified out-of-court dispute settlement or another external remedy, these Terms do not prevent the user from using that remedy.
Phaser may suspend or terminate an account where reasonably necessary because of:
Except where immediate action is reasonably necessary, Phaser will seek to provide notice of material account restrictions and the principal reason for them.
Immediate action may be necessary to address urgent security, fraud, safety, legal, or evidence-preservation concerns.
You may request deletion of your account through the available account controls.

Deletion may require reasonable technical processing time.
Some limited information may remain temporarily in backups or be retained where reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, or legal claims.
Content involving other users may be retained in anonymised form or where deletion would improperly affect their rights or records, subject to applicable law.
Users should keep independent copies of any material they consider important.
Phaser may maintain backups for operational continuity, recovery, technical, and security purposes.
Phaser does not guarantee that deleted, corrupted, or lost User Content can be restored.
Nothing in this section limits any legal obligation Phaser may have concerning data security, availability, or restoration.
The Service is provided on an “as available” basis, subject to mandatory legal protections.
Phaser does not guarantee that:
Phaser will take reasonable measures appropriate to the nature and scale of the Service to maintain security and operational continuity.
Phaser may update, redesign, replace, limit, suspend, or discontinue features for reasons including:
Where a planned change materially and negatively affects an ongoing user relationship, Phaser will provide reasonable notice where practicable, unless immediate action is needed for security, legal, or technical reasons.
Phaser may introduce optional paid services, subscriptions, promotional tools, or premium features.
Before a user purchases a paid service, Phaser will provide the applicable price, main characteristics, billing terms, duration, renewal conditions, cancellation information, and any additional terms required by law.
Introducing paid features does not automatically convert existing free features into paid services without appropriate information and a valid user choice where required.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence where applicable, or injury caused by conduct for which liability cannot lawfully be excluded.
Subject to mandatory law, Phaser is not responsible for losses caused exclusively by:
Phaser does not guarantee profits, revenue, professional opportunities, engagement, followers, contacts, visibility, ranking, or commercial success.
Any limitation in these Terms applies only to the maximum extent permitted by applicable law and must not be interpreted as excluding mandatory consumer rights or Phaser's own legal responsibilities.
Users remain responsible for User Content they submit and for rights they claim to possess.
Phaser does not routinely pre-approve every item of User Content and is not required to conduct general monitoring except where applicable law provides otherwise.
Phaser will process sufficiently precise reports and remove or disable access to content where required by law or reasonably appropriate under these Terms.
Nothing in this section excludes any responsibility Phaser may have after obtaining relevant knowledge of illegal content or through Phaser's own direct conduct.
To the extent permitted by applicable law, a user may be responsible for reasonable losses, liabilities, and costs arising from a third-party claim caused by the user's unlawful User Content, intentional misconduct, or material breach of these Terms.
This provision does not require a consumer to indemnify Phaser for:
Phaser will take reasonable steps to notify the affected user of a relevant third-party claim and allow reasonable participation in the response where appropriate.
Profiles, Picks, rankings, recommendations, reviews, and discovery results are provided for music-discovery, informational, promotional, and community purposes.
They do not constitute legal, financial, contractual, investment, or other professional advice.
Unless expressly stated, Phaser does not endorse, represent, sponsor, or guarantee any artist, fan, profile, track, statement, opportunity, link, or third-party service.
Complaints involving copyright, trademark, neighbouring rights, image rights, publicity rights, privacy rights, or other protected rights should be submitted in accordance with Phaser's Intellectual Property Policy.
Phaser may temporarily remove or restrict allegedly infringing material while a complaint is reviewed.
Serious or repeated infringement may result in account suspension or termination.
Phaser processes personal data as described in its Privacy Policy.

Phaser may update these Terms where reasonably necessary because of:
The updated Terms will be published with a revised “Last updated” date.
Where a change materially affects users' rights or obligations, Phaser will provide reasonable advance notice where required or reasonably practicable.
If a material change requires new consent under applicable law, continued use alone will not replace that consent.
Users who do not accept a material change may stop using Phaser and delete their account, subject to any mandatory rights that remain available.
These Terms are governed by Italian law.
This choice of law does not deprive a consumer residing in another country of mandatory protections granted by the law that would otherwise apply.
Disputes will be submitted to the courts having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to waive a mandatory right to bring proceedings before the competent court of their place of residence where applicable law provides that right.
These Terms, together with the policies expressly incorporated into them, form the agreement governing use of Phaser.
They replace prior versions or understandings concerning the same subject, without affecting rights or obligations that accrued before replacement.
If a provision of these Terms is found invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary where legally possible.
The remaining provisions will continue to apply.
A failure or delay by Phaser in enforcing a provision does not automatically waive the right to enforce it later.
